WHAT IS TITLE INSURANCE?
“Title” refers to your documentary evidence (a Warranty Deed, for example) of rightful ownership of real estate. Title insurance protects that rightful ownership from claims of others relating to circumstances that occurred BEFORE you acquired title. Title insurance is purchased during the closing or “settlement” process through payment of a one-time premium that protects you and your heirs from claims that challenge your rightful ownership. Throughout Florida, title insurance is generally purchased by a Seller for the Buyer’s benefit, but in Miami-Dade and Broward Counties, the Buyer generally selects the title insurance agent to be used for settlement and pays for their own Buyers (“Owner’s”) title insurance policy. The cost of title insurance varies, depending upon the value of your property and if you obtained mortgage financing to purchase your property, but cannot exceed the rates authorized by the State of Florida (Please see the “Rate Chart” in the Information / Links section of this site for a rough idea of the cost of the basic Owners insurance policy).
